Le 25 octobre 2010, le Conseil a adopté la décision 2010/638/PESC [2], qui renouvelait les mesures restrictives jusqu’au 27 octobre 2011 et abrogeait la position commune 2009/788/PESC.	On 25 October 2010, the Council adopted Decision 2010/638/CFSP [2] renewing the restrictive measures until 27 October 2011 and repealing Common Position 2009/788/CFSP.
Ce texte abrogeait la loi qui définissait le TIPNIS comme une zone protégée, faisant craindre la mise en œuvre éventuelle d’autres projets d’infrastructures et d’extraction dans cette zone.	This Law repealed legislation under which the TIPNIS was a protected area, raising concerns about possible development of other infrastructure and extractive projects in the area.
Premièrement, la mesure examinée ne constituait pas un simple remplacement des mesures existantes mais une nouvelle mesure autonome, car elle n’abrogeait ni ne remplaçait un régime antérieur.	Firstly, this measure was not a pure replacement of the existing measures, but a new stand alone measure, as it did not repeal or replace any previous measure.
